Terms of Service

These Terms govern access to 360 Growth Solution and 360growthsolution.com, operated by High Value Capital Group LLC. By using the site or product, you agree to these Terms.

1. The product

360 Growth Solution is a marketing technology and growth-intelligence platform. It is not a bank, law firm, CPA firm, or medical provider. Marketing results are not guaranteed.

2. Operator

3. Authorized use

You may use the platform only with authorized business accounts, for lawful purposes, and in accordance with these Terms and applicable third-party platform terms (including Google).

4. Google connections

If you connect Google Ads or other Google services, you represent that you have authority to grant that access. Use of Google services remains subject to Google’s terms. 360 Growth Solution is not endorsed by Google and is not a Google partner by virtue of OAuth or API use.

5. Approvals and automation

Default autonomy requires human approval. Feature flags, budget caps, and emergency pause may block actions. Safeguards do not replace your legal or advertising-compliance review. Official or paid-media actions remain subject to your authorization and, where applicable, Google API access approval.

6. Customer content and claims

You are responsible for the accuracy, legality, and industry-specific compliance of advertising content, offers, and disclosures. Healthcare advertising restrictions remain yours to satisfy.

7. Fees

Product fees, if any, are as separately agreed in an order form or written agreement. These Terms do not create a public price list.

8. Intellectual property

HVCG retains rights in the 360 Growth Solution software and branding. You retain rights in your content and grant HVCG a limited license to process it to provide the service.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not guarantee advertising performance, lead volume, or revenue.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE SERVICE IS LIMITED TO FEES PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF NO FEES WERE PAID).

11. Indemnification

You will indemnify HVCG from claims arising from your content, connected accounts, misuse of the service, or violation of law or third-party terms, except to the extent caused by our willful misconduct.

12. Governing law

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules, unless a written customer agreement specifies otherwise.
